Website Design & Development Terms

Last updated: September 8, 2026. These terms govern website-design and related services offered by Cosmic Exposure through the Yoga Founders Magazine brand.

1. The free private preview

Cosmic Exposure may create a private website preview for prospective clients to review. A preview is provided for evaluation only. It is not a public launch, final handover, assignment of ownership, or permission to use the work commercially unless the parties agree otherwise in writing.

2. Scope, timing, and changes

We perform the services and deliverables stated in the accepted written scope. New pages, features, integrations, substantial redesigns, replacement content, or other material changes outside that scope may require a separate quote and written approval. Timelines depend on timely client content, access, feedback, approvals, and payments. We are not responsible for missed dates caused by client delay or missing access.

3. Payment, launch, and ownership

Payment milestones, project fees, and any recurring service fees are stated in the accepted proposal or agreement. We may pause work for overdue payments. Final launch, handover, migration, and transfer of final deliverables may be withheld until amounts due are paid, subject to applicable law.

Once all applicable amounts are paid, the client receives rights to the final client-specific deliverables as stated in the project agreement. Cosmic Exposure retains its pre-existing tools, reusable code, methods, templates, know-how, libraries, and portfolio rights unless expressly transferred in writing. Third-party materials remain subject to their own licences.

4. 100% design satisfaction guarantee

If a client is dissatisfied with the final website design we deliver, the client may request a refund of the one-time website-design fee within 14 days of final design delivery. This guarantee applies to the agreed design scope only. It does not apply to monthly retainer fees, hosting, domains, plugins, stock assets, payment-processor charges, advertising spend, or other third-party costs.

The guarantee does not promise a particular Google ranking, traffic level, number of bookings, revenue result, or performance of a third-party platform. It also does not apply to work delayed or prevented by missing client content, access, approvals, payments, or client-requested scope changes.

5. Monthly retainer cancellation

The $99 monthly retainer has an initial three-month minimum period unless a written agreement says otherwise. After the initial three months, the client may cancel the monthly service before the next billing date. Services remain active through the paid billing period. Fees for an already-started billing period are not pro-rated or refunded, except where required by law.

6. Client content, accounts, and lawful use

The client is responsible for the accuracy, legality, and permissions for all content, products, services, claims, testimonials, images, trademarks, data, and materials they provide or publish. The client is also responsible for their business operations, customer communications, domain, hosting, email, payment, and third-party-service accounts.

After launch, handover, or transfer of access, the client is solely responsible for use of the website and related accounts. Cosmic Exposure acts as a developer and is not responsible for unlawful, fraudulent, misleading, infringing, prohibited, or otherwise improper activity carried out by the client, the client’s users, or through the client’s website, to the extent permitted by applicable law.

7. Third parties and results

Domains, hosting providers, browsers, search engines, payment processors, plugins, APIs, and other third parties operate independently. We are not responsible for their outages, suspensions, policy changes, price changes, verification delays, or failures. We test for reasonable compatibility with current major browsers, but cannot guarantee identical display on every device or screen.

8. Limitation of liability and governing law

To the extent permitted by applicable law, Cosmic Exposure’s total liability relating to a service is limited to the amount paid to Cosmic Exposure for that specific service in the three months before the event giving rise to the claim. Nothing in these terms excludes liability that cannot lawfully be excluded.

These terms are governed by the laws of India. Courts in Rajasthan, India will have jurisdiction, subject to applicable law and any agreed dispute-resolution process.
